Averis Counsel
Ajit S. Dang founded Averis in 2018 after practicing law for the prior decade as a Principal at Fish & Richardson, one of the largest and most successful intellectual property firms in the United States.
There, he specialized in complex patent litigation in the International Trade Commission (ITC) and Federal courts covering a diverse range of technologies from CMOS image sensors to cellular and Wi-Fi systems and standards, to turbocharger and bearing design. His experience covers all major aspects of litigation from pre-filing investigations to appeal at the Federal Circuit.
Before starting his practice, Mr. Dang served as an extern for Justice Cantero, III of the Florida Supreme Court. He also gained valuable business and engineering experience working in software design and network engineering before entering the field of law. While studying computer science at Stetson, he worked as a PHP/MySQL application developer for the university, a network engineer for one of the largest IT consulting firms in Florida, and a network administrator for a hedge fund company. He received his J.D., magna cum laude, Order of the Coif, from the University of Miami School of Law in 2008 and his B.S. in computer science from Stetson University in 2005.

ITC Investigation re CMOS Image Sensors
Represented complainants in a multi-patent investigation at the ITC related to CMOS image sensor and camera technologies. Managed a team of over a dozen attorneys from pre-institution through expert discovery, including arguing on behalf of complainants at the Markman hearing before ALJ McNamara and deposing respondents’ technical experts and engineers.
ITC Investigation re RF Transceivers
Represented a major handset maker in a multi-patent investigation at the ITC related to radio transceiver and standard-essential cellular technologies. Defended respondent against core RF transceiver patents concerning cellular, Wi-Fi, and Bluetooth technologies, from pre-institution analysis through trial including deposing complainants’ technical experts, inventors, and engineers.
District Court (CDCAL) Case re Enterprise E-Commerce Systems
Represented a leading chip maker in a multi-patent case in the Central District of California related to B2B web commerce technologies. Helped obtain dismissal of the case after a protracted reexamination, including successfully disqualifying patentee’s counsel prior to the PTAB hearing. Also helped successfully oppose plaintiff’s attempt to add new claims and obtain further discovery, and ultimately obtained complete dismissal of the eight-year pending case.
ITC Investigation re Digital TV SoCs
Represented leading Taiwanese chip makers in a multi-patent investigation at the ITC related to multimedia data processing in SoCs. Managed asserted patents from pre-institution through expert discovery, including defending respondents’ key technical engineers.
Appellate (CAFC) & District Court (SDFLA) Trade Secret Case re Turbocharger Design
Represented plaintiff-appellant in a successful appeal to the Federal Circuit regarding the 12(b)(6) dismissal of its trade secret cause of action in the Southern District of Florida. Helped obtain a precedential decision reversing the lower court’s dismissal under Twombly/Iqbal, including drafting the appeal briefs.
District Court (EDTEX) Case re Digital TV SoCs
Represented a leading TV and STB maker in a multi-patent case in the Eastern District of Texas related to digital video recording technologies. Defended the company against core multimedia processing patents through all aspects of the litigation, including claim construction, infringement and invalidity analyses, and technical witness depositions.
District Court (EDTEX) Case re E-Commerce Platforms
Represented a leading CPQ solution provider and its customers in a patent case in the Eastern District of Texas filed by one of the most prolific and well-funded non-practicing entities. Defended the company and its customers against allegations of infringement regarding a patent describing sales force automation technologies, including arguing on behalf of the company and its customers and co-defendants at the Markman hearing before Magistrate Judge Love.
